Terms & Conditions

Website development, maintenance and Website Health Check terms applicable to all services provided by JK Operational Services / JK WebApp.

Website Development Terms & Conditions

These Terms & Conditions apply to all website design, development, eCommerce, SEO, hosting, maintenance, and related digital services provided by JK Operational Services / JK WebApp.

1. Project Specification and Scope of Work

Before any project begins, both parties will agree on a detailed project specification (Scope of Work).

The specification will define:

  • Number of pages
  • Features and functionality
  • Design requirements
  • Integrations
  • Content and media to be provided by the client

Any estimate given before the final specification is agreed is only provisional and may change.

A formal quotation, project timeline, and commencement date will be provided after the scope is finalized.

Work will begin only after:

  • Written approval of the quotation
  • Acceptance of these Terms & Conditions
  • Receipt of the required advance payment
  • Submission of all required materials

2. Payment Terms

Standard Payment Structure

  • 50% Advance Payment is required before work begins.
  • 50% Final Payment is due upon project completion and before website deployment or handover.

Alternative Payment Structure

For large or long-term projects, JK Operational Services may choose to use:

  • 60% Advance
  • 40% Final Payment

Additional Payment Conditions

  • All invoices are payable within 7 calendar days of the invoice date unless otherwise specified.
  • If a project extends beyond 30 days, interim invoices may be raised based on completed work.
  • Advance payments are non-refundable once work has commenced.
  • If the client cancels the project after work has started, payment will be due for all work completed up to the cancellation date.
  • Ownership of the website and source files remains with JK Operational Services until all outstanding invoices are paid in full.

3. Project Timeline and Completion

  • Estimated completion dates are provided in good faith and depend on timely approvals and content submission by the client.
  • Delays caused by the client (e.g., missing content, delayed approvals, incomplete information) will extend the project timeline.
  • JK Operational Services will make every reasonable effort to meet agreed deadlines.

Completion dates may be adjusted due to:

  • Scope changes
  • Third-party delays
  • Technical issues
  • Force majeure events

4. Change Requests and Additional Work

  • Any request for changes after project approval must be submitted in writing.
  • Changes outside the original scope will be treated as additional work and charged separately.

Additional work may require:

  • Revised timelines
  • Interim invoices
  • Advance payment before implementation

5. Client Responsibilities

The client is responsible for providing:

  • Logo and branding assets
  • Content and product information
  • Images and videos
  • Legal policy content (or approval of standard templates)
  • Payment gateway credentials
  • Domain and hosting access
  • Required licenses and permissions

The client warrants that all materials provided are lawful and do not infringe third-party rights.

6. Browser, Device, and Compatibility Testing

Websites are developed to support the latest stable versions of:

  • Google Chrome
  • Mozilla Firefox
  • Microsoft Edge
  • Safari
  • Opera

Responsive websites are tested on standard desktop, tablet, and mobile devices. Support for outdated browsers or specialized devices is not included unless specifically agreed.

7. Client Review and Acceptance

  • The client must review the completed project and provide feedback within 7 calendar days.
  • If no feedback is received within this period, the project will be deemed accepted.
  • Any corrections requested after acceptance may be billed separately unless they are genuine defects.

8. Deployment and Go-Live

The website will be deployed only after:

  • Final payment is received
  • Client approval is given
  • Required credentials are provided

JK Operational Services is not responsible for delays caused by hosting providers, domain registrars, or payment gateway approval.

9. Hosting and Domain Registration

Web Hosting

  • Hosting fees are charged separately unless included in the quotation.
  • Hosting is payable in advance (monthly or annually).
  • Hosting invoices not paid within 7 days of the due date may result in account suspension.
  • No refunds are provided for unused hosting periods.

Domain Names

  • Domain names are registered on behalf of the client.
  • Renewal charges are the client's responsibility.
  • Domain fees are non-refundable once registered.

10. Third-Party Services

Third-party services may include:

  • Razorpay
  • PayU
  • Instamojo
  • Meta WhatsApp
  • Email services
  • SMS providers
  • Shipping APIs

The client is responsible for account approvals, KYC, subscriptions, and ongoing third-party charges.

11. SEO and Marketing Disclaimer

Unless specifically included in the quotation:

  • Search engine rankings are not guaranteed.
  • Lead generation and sales results are not guaranteed.
  • Advertising costs are not included.

12. Intellectual Property and Ownership

All code, design files, and materials remain the property of JK Operational Services until full payment is received.

After full payment, the client receives ownership of the custom-developed website components, excluding:

  • Licensed software
  • Third-party plugins
  • Stock assets
  • Proprietary tools

13. Confidentiality

Both parties agree to keep confidential all business, technical, and commercial information shared during the project.

14. Warranty and Support

A 30-day bug-fix warranty is provided after project delivery.

The warranty covers defects related to the agreed functionality.

The warranty does not cover:

  • New feature requests
  • Content updates
  • Third-party service issues
  • Hosting/server problems
  • Client-caused modifications

15. Maintenance and Updates

Ongoing maintenance, backups, monitoring, and content updates are not included unless covered by a separate maintenance agreement.

16. Suspension of Work

JK Operational Services reserves the right to pause work if:

  • Payments are overdue
  • Required materials are not provided
  • Communication is unreasonably delayed
  • The client breaches these terms

17. Limitation of Liability

JK Operational Services shall not be liable for:

  • Loss of profits or business opportunities
  • Data loss
  • Cyberattacks or hacking
  • Server outages
  • Third-party failures
  • Indirect or consequential damages

Total liability shall not exceed the total fees paid by the client for the project.

18. Force Majeure

Neither party shall be liable for delays or failures caused by events beyond reasonable control, including natural disasters, internet outages, government actions, labor disruptions, or technical failures.

19. Termination

Either party may terminate the project in writing. The client remains liable for all work completed and expenses incurred up to the termination date.

20. Refund Policy

  • Advance payments are non-refundable once work has commenced.
  • Domain registration, hosting, and third-party charges are non-refundable.
  • Refunds are not provided for completed work or approved milestones.

21. Legal Compliance

The client is solely responsible for ensuring the website content, products, and business operations comply with all applicable laws and regulations in India and any target markets.

22. Governing Law and Jurisdiction

These Terms & Conditions are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of courts located in Pune.

23. Acceptance of Terms

Payment of the advance amount, signing the quotation, or providing written approval constitutes acceptance of these Terms & Conditions in full.

24. Domain and Hosting Provider Disclaimer

Domain registration and web hosting services are provided by third-party companies such as Hostinger, GoDaddy, and other similar providers.

JK Operational Services acts only as a facilitator when assisting with domain registration, hosting setup, DNS configuration, SSL installation, and related technical tasks.

JK Operational Services is not responsible for any issues arising from third-party providers, including but not limited to:

  • Server downtime or outages
  • Slow server performance
  • Email delivery issues
  • DNS propagation delays
  • SSL certificate errors
  • Domain suspension or expiration
  • Account suspension due to provider policies
  • Data loss caused by hosting failures
  • Billing disputes with the provider

The client is solely responsible for:

  • Paying domain and hosting renewal fees on time
  • Maintaining account access credentials
  • Complying with the hosting provider's terms and policies

Any troubleshooting, migration, restoration, or support required due to third-party provider issues may be charged separately.

JK Operational Services does not guarantee the uptime, security, or performance of any third-party hosting or domain provider.

Any compensation or refund related to hosting or domain issues must be claimed directly from the respective service provider.

Website Maintenance Terms & Conditions

₹2,000 / Month • Up to 25 Working Hours

Included Support Hours

  • Content updates
  • Product uploads
  • Banner changes
  • Minor design changes
  • Bug fixes
  • Plugin updates
  • Basic SEO updates
  • Security monitoring
  • Backup checks

Work Log / Worksheet

A detailed worksheet (timesheet) will be maintained for all tasks performed. The worksheet will include: Date, Task description, Time spent,Total monthly hours used. The worksheet can be shared with the client upon request or with the monthly invoice.

Additional Work

If the total work exceeds 25 hours in a month, additional work will be billed separately. Additional charges will be based on the complexity, urgency, and scope of the work. The monthly fee may be revised if the client's requirements increase significantly.

Unused Hours

Unused hours do not roll over to the next month unless specifically agreed in writing.

Response Time

Standard maintenance requests will typically be addressed within 24 to 72 business hours. Urgent requests may be prioritized based on availability.

Exclusions

The maintenance plan does not include:

  • Complete website redesign
  • New feature development
  • Third-party premium licenses
  • Domain and hosting renewal fees
  • Payment gateway charges
  • Content creation, photography, or copywriting (unless specifically agreed)

Payment and Cancellation

Maintenance fees are payable monthly in advance. Work will commence after payment is received. Overdue payments may result in suspension of maintenance services. Either party may cancel the maintenance plan with 15 days' written notice. Fees already paid are non-refundable.

Price Revision

The maintenance fee of ₹2,000/- per month is based on the current scope and may vary depending on actual work requirements and workload. Any change in pricing will be communicated in advance and implemented only after mutual agreement.

Acceptance

Payment of the maintenance invoice constitutes acceptance of these maintenance terms.

Website Health Check

₹2,000 One-Time Fee

Many websites require assistance with site performance, and some owners are no longer in touch with the original creator. A site assessment of these websites is beneficial in order to develop new goals and possibly refocus the website’s purpose.

What the Website Health Check Evaluates

The Website Health Check evaluates:

  • Site performance
  • Page content and code
  • Link problems
  • Calls to action
  • Mobile device usability
  • Social media effectiveness

On location, three tests will be conducted. They will highlight both positive aspects and issues that may arise, giving you a comprehensive overview of your site – a full check-up.

In a small number of situations, some tests may not be performed for technical reasons. In such cases, an update and/or alternative report will be provided.

The Website Health Check costs Rs 2000.00.

Site Performance Test

Using professional performance assessment tools, we evaluate the speed and performance of your website’s homepage and additional pages as needed.

Why performance matters:

  • Faster websites lead to higher conversions and sales – users do not enjoy waiting for slow-loading pages.
  • Studies show that a significant percentage of mobile site visits are abandoned if a page takes longer than a few seconds to load.
  • Search engines such as Google consider site speed as an important ranking factor.

Page Scan Test

We scan up to 500 pages of your website to review page code and content. This analysis is essential for search engine positioning and represents the overall quality of your website’s structure.

The test identifies:

  • A list of pages and headings.
  • Missing files and broken links.
  • Other technical or content-related issues that may impact performance.

The results can form the basis for a content review and audit of your site.

Site Overview Test

While the above tests focus on specific areas, the Overview Test provides a broad summary of your website’s overall health, including:

  • Social media presence and following.
  • Coding standards and requirements.
  • Spelling and grammar accuracy.
  • Reading comprehension levels of your content.
  • Usability and user experience checks on mobile devices.

Drawing on years of web development and usability experience, we evaluate elements such as:

  • Navigation and usability.
  • Mobile responsiveness.
  • Effectiveness of call-to-action placements.

Outcome

The Website Health Check provides you with a comprehensive analysis of your website. Reports may highlight simple fixes, which you can address with your existing web designer or developer.

Having a clear plan for website improvement provides a strong foundation for long-term digital growth.

Payment Terms

Full payment is required in advance. Website Health Check fees are non-refundable.
